Thank you for visiting www.crocs.eu (the "Website"). These general terms and conditions of sale ("Terms and Conditions") are applicable to all purchases of products on this Website.
This Website is operated by Crocs Europe B.V., a limited liability company incorporated under the laws of The Netherlands, with its main offices at Zeesluisweg 228, 2583 ES, The Hague, The Netherlands, registered at the Chamber of Commerce of Haaglanden, The Netherlands under No. 27276812 with V.A.T. No. 814 339 323 B01. Crocs Europe B.V. is a subsidiary of Crocs Inc. located at 6328 Monarch Park Place, Niwot, Colorado 80503, U.S.A (hereinafter collectively: "Crocs").
The terms "Crocs", "we", "us" and "our" when used in these Terms and Conditions means Crocs and its subsidiaries, divisions, branches, affiliates or companies under common ownership or control of Crocs.
The terms "you" and "your" when used in these Terms and Conditions means any person purchasing products on/through this Website.2. Governing Provisions
Purchasing of products on this Website is subject to all applicable laws and regulations and to these Terms and Conditions. You accept, without limitation or qualification, these Terms and Conditions, which form a legally binding agreement between you and Crocs, when the first of the following occurs:
(a) you order goods through this website;
(b) you pay for the ordered goods;
(c) you have received delivery of the whole or any part of the ordered goods; or
(d) you have otherwise assented to these Terms and Conditions.If you do not agree, please exit this Website.
These Terms and Conditions may be changed by us from time to time without specific notice to you. The latest Terms and Conditions will be posted on the Website, and you should always review these Terms and Conditions prior to using the Website to ensure that you have a current understanding of the Terms and Conditions under which you are permitted to access this Website. 3. Entire Agreement
These Terms and Conditions (together with our Privacy Policy and Terms of Use, which are expressly incorporated herein by reference and can be accessed on this Website) contain the entire understanding between you and us with respect to use of this Website and no representation, statement, inducement oral or written, not contained herein shall bind any party to this agreement. No additional or different terms or conditions will be binding upon us unless specifically agreed to in writing by an officer of Crocs. No other representative has any authority to waive, alter, vary or add to the terms hereof. Before using this Website please read through all these documents carefully.
4. Minors
This Website is a business and commercial site. As such, it is not intended for children or minors under the age of 18 years without the permission of a parent or guardian. In addition, you must be at least 18 years of age to make a purchase on this Website.
5. General Ordering Information
Orders can be placed any time, 24 hours a day, seven days a week.
We can only fulfill an order if the delivery address is a home or office address in one of the countries we ship to. Please see the link on this Website to Frequently Asked Questions ("FAQs") for a list of countries where we ship to.
An order is placed once you click the “continue to checkout” button on the "Check and Confirm" page in the ordering process. By clicking the submit button, your order is sent to us as displayed. Once we have received your order, an automated confirmation of receipt will be sent to the e-mail address specified by you in the ordering process. The e-mail will contain your order number and the details of your purchase. The purchase agreement has now been completed. We reserve the right to refuse your order or to cancel the purchase agreement.
When you send us your order, we may run certain checks on it before the order is fulfilled. These checks may include verifying your address and creditworthiness. By submitting your order, you agree to this.
6. Prices
The prices for the products displayed on the Website are inclusive of Value Added Tax (V.A.T.). On adding a product to your shopping cart, the V.A.T. applicable in the country to where the products are shipped to, will be added to the amount of your purchase.
Shipping costs are applied per order. The exact shipping costs depend on the country to which your order is shipped. For details on the rates per country please see the link on this Website to the FAQs page. V.A.T, shipping costs and all other taxes, fees or charges of any nature whatsoever imposed by any governmental authority shall be added to the total amount of your purchase.
The prices displayed on the Website are subject to change. We reserve the right to change prices at all times and without notice. The prices displayed on the Website at any moment are only valid at that moment.
Although the Website is composed with care, it may happen that the pricing information on the Website contains errors. We are not bound by our offer and we reserve the right to cancel your purchase in the event of spelling, pricing, or other errors in the website information.
7. Crocs' Right to Refuse Order and Cancel Purchase
We reserve the right, for whatever reason, to refuse any order or to cancel any purchase. Some of the situations in which we may do so are:
(a) the product(s) is (are) not available and/or not in stock;
(b) your billing information is not correct or not verifiable;
(c) your payment is not confirmed/authorized by our automated payment confirmation service;
(d) the displayed price of the product(s) was incorrect; or
(e) we could not deliver at the address provided by you8. Delivery & Returns
Defective Products
Products should be checked upon delivery. If it appears that the products, at the time of delivery, are damaged or otherwise show material or manufacturing defects, return the products to us. Please follow the below procedure for returning any defective items:
(a) First, you need to have a Return Materials Authorization (”RMA”). The RMA comprises a RMA label and a RMA number. The RMA allows you to return the defective product free of shipping charges (covered by the RMA Label) and helps us to properly process your return (by referring to your RMA number);
(b)If you are a registered customer, then please log into your account. A RMA number can be requested next to the order details within 30 days after the delivery.;
(c)If you are a not a registered customer, then please go to the Customer Service page and fill in your order number and name. Your order details will then show after which you can select the products you want to return;
(d) Indicate whether you wish to have new product sent to you, in which case you do not have to place a new order, or whether you wish to have a refund. You will get a refund within 10 business days after we have received the original items. The refund will be issued to the original card/account;
(e) Within a few days you will receive an RMA (Return Merchandise Authorization) number. Please send the items back using the return label which we will be sending to you when confirming your RMA number;
(f) For returns accomplished without an RMA number, administration costs for the amount of £ 4.95 will be deducted from the total amount that is to be refunded. From 1 September 2010 packages without an RMA number will not be processed anymore.
(g) Please be aware that your package should meet the following requirements:

When you have more than 2 kg (4.4 lbs) to return, please, use the second label and send two separate packages;
(h)NOTE: Customers from Estonia, Lithuania, Monaco, Northern Ireland, Spain, Portugal and San Marino CANNOT use the RMA label. We are currently working on a solution for these countries. If you are from one of the above mentioned countries, return your package to Crocs Warehouse, Internet sales, Shannonweg 68, 3197 LH Rotterdam, The Netherlands. To obtain a refund for your shipping costs, please send us a receipt for the shipping costs by e-mail to websales@crocs.eu. IF you do not have an e-mail facility, please send a hard copy of your receipt to Crocs Europe B.V. f.a.o. Websales, P.O. Box 84420, 2508 AK, The Hague, The Netherlands stating your RMA number. DO NOT send (a copy of) your shipping receipt together with the returned products. If you do, we will not be able to refund your shipping costs.
(i) Upon receipt of the goods we will assess the nature of the defect and if the defect falls under our warranty terms we will either send you new product or a full refund depending on which option you have chosen for. It is possible that an item ordered by you might not be in stock at the time of processing your return. In that case we will send you new product once we have the product in stock.Non-Defective Products
If, after you have accepted delivery, you are not happy with what you ordered for any reason other than a defect under our warranty terms (e.g. you are not happy with the color or size), and wish to return the products, you may do so within 30 calendar days after delivery, as long as
(a) the products are unwashed and not used in any way;
(b) the products are in their original undamaged packaging (a carefully opened package will not be considered damaged);
(c) the product is complete: e.g. both items of a pair must be returned;You may not return:
(a) products that are tampered with;
(b) products which are personalized in any way;
(c) product bought in shops other than Crocs' webshop.The procedure for returning non defective products is the same as described above for returning defective products, with the exception that we will refund only the purchase price of any returned, non-defective products. We will not refund the shipping costs you originally paid. You will also have to pay for the shipping costs to us of any such returned non-defective products.
All product returns should be sent to Crocs Europe BV, F.a.o. Internetsales, Shannonweg 68, 3197 LH, Rotterdam, The Netherlands.

9. Warranty
The warranty for Crocs Products applies to defects in materials and workmanship for a period of 30 days from the date of delivery of the Products to you. Products of which you have reason to believe are defective as regards materials and workmanship, should be returned to the address mentioned in section 8 above within two months of the date on which you detected the defect. If, at the sole discretion of Crocs, the returned products are deemed to be defective due to material or manufacturing defects, the products shall be repaired, be replaced or the purchase price be credited to you. Your rights under applicable Dutch law governing the sale of consumer goods shall not be affected by the warranty given in this article.
10. No Warranty
Except as set forth in section 8, all products are provided as is. Crocs makes no representation or warranty of any kind whatsoever, whether express, implied or statutory, including, without limitation, any implied warranties of merchantability, non-infringement or fitness for a particular purpose. No person (including any agent, dealer or representative of Crocs) is authorized to make any representation or warranty concerning products except to refer you to this warranty, and you acknowledge and agree that you have not relied on any other warranties or representations.
11. Limitation of Liability:
In no event shall Crocs be liable for any indirect, incidental or consequential damages of any kind, whether for breach of any warranty or otherwise. In no event shall our aggregate liability to you arising under or in any way related to your purchase order, the transaction to be entered into pursuant to it or these Terms and Conditions exceed the total amount paid by you for the products purchased. For the avoidance of doubt, nothing contained herein shall limit Crocs' liability for death or personal injury arising out of its negligence or for fraudulent misrepresentation.
12. Recall
You will cooperate fully with us and will provide all reasonable assistance in the event we recall any product(s). You shall notify us immediately if you know or suspect there is a possibility of products becoming or needing to become the subject of a recall.
13. Force Majeure
Crocs shall not be liable for any damage as a result of any delay or failure to deliver due to any act of God, act of you, embargo or other governmental act, regulation or request, fire, accident, power outage, strike, slowdown or other labor difficulties, war, riot, act of terrorism, delay in transportation, defaults of common carriers, inability to obtain necessary labor, materials or manufacturing facilities or, without limiting the foregoing, any other delays beyond Crocs' control. In the event of any such delay the approximate indicated date of delivery shall be extended for a period equal to the time lost because of the delay. Your exclusive remedy for other delays and for Crocs' inability to deliver for any reason, shall be cancellation of your order for such products upon provision to Crocs of written notice to that effect.
14. Intellectual Property Rights
The Crocs logo, all product names, all page headers, all custom graphics, all button icons, all trademarks, service marks and logos appearing on this Website, unless otherwise noted, are service marks, trademarks (whether registered or not) and/or trade dress of Crocs (the "Marks"). All other trademarks, product names, company names, logos, service marks and/or trade dress mentioned, displayed, cited or otherwise indicated on the Website are the property of their respective owners. You are not authorized to display or use the Marks in any manner without our prior written permission. You are not authorized to display or use trademarks, product names, company names, logos, service marks and/or trade dress of other owners without the prior written permission of such owners.
You shall not to tamper, alter, detract from or otherwise change any of the Marks on the products. We retain all intellectual property rights in the products and you undertake that you shall do nothing which may damage, detract from or otherwise harm Crocs' ownership in and/or the value of such intellectual property rights. The use or misuse of the Marks or other trademarks, product names, company names, logos, service marks and/or trade dress or any other materials contained herein, except as permitted herein, is expressly prohibited.15. Governing Law and Jurisdiction
These Terms and Conditions and the transactions governed by these Terms and Conditions shall be exclusively governed and construed according to the laws of The Netherlands. The applicability of the Vienna Convention on the International Sale of Goods is explicitly excluded.
Any disputes relating to or arising out of these Terms and Conditions and/or any transactions governed by these Terms and conditions will be exclusively submitted to the competent court of The Hague, The Netherlands.

(a) Any orders placed before or after the discount period shall not benefit from the discount;
(b) A discount cannot be used in combination with any other discount;
(c) Crocs reserves the right to end any discount at any time;
(d) Crocs reserves the right to extend any discount for any period;

17. Title to Products
The title to any products ordered through this Website shall transfer to you upon receipt by us of full payment.
